MEDIATION
The Family Law Act describes mediation as a process in which a mediator helps people affected, or likely to be affected by separation or divorce, to resolve some, or all of their disputes with each other and is independent of all the parties involved in the process.
In most parenting cases, parties are required to attend mediation prior to commencing proceedings in the Federal Circuit & Family Court of Australia.
There are many benefits in trying to settle your parenting dispute or your property dispute through mediation. Some of the benefits include:
-
Mediation is more cost effective than being involved in protracted negotiations or proceedings in the Federal Circuit & Family Court;
-
Mediation is a confidential process;
-
The timeframes for engagement in and completion of the mediation process is usually measured in weeks, as opposed to Court proceedings which can be on foot for more than a year;
-
Mediation allows parties to have control over the outcome as opposed to a litigated outcome where a decision is imposed on the parties;
-
Mediation allows parties to discuss the underlying issues that have led to the dispute which can result in more long lasting and satisfying agreement being made.
